Washington, D.C. | Statement from Jenin Younes, President and Legal Director of the American-Arab Anti-Discrimination Committee (ADC), on calls by the Hind Rajab Foundation (HRF) for the Trump administration to arrest Israeli military commander, Sean Glass, who is accused of ordering the attack that killed five-year-old Palestinian girl Hind Rajab and members of her family in Gaza in January 2024.

As the HRF has shown, substantial evidence — including satellite imagery, forensic evidence, and Glass’ own posts — corroborates the finding that Glass not only served as a commanding officer in the IDF, but also was responsible for the killing of Hind, six members of her family, and the paramedics who attempted to save her.

“The Hind Rajab Foundation has put forth more than enough evidence to arrest Glass. The U.S. Department of Justice must take immediate action to bring Glass and any others involved to justice. If Hind had been a child of any other ethnicity, Glass would already be behind bars. While nothing can bring Hind back, justice and accountability are the least that she, her loved ones, and the world deserve, and the US government can start by prosecuting Glass and other members of his unit.

The United States has the legal authority to act. The War Crimes Act, expanded by the Justice for Victims of War Crimes Act of 2023, expressly provides for the prosecution of alleged war criminals present on American soil, regardless of their nationality, where their crimes occurred, or whether their victims were American citizens. Similarly, the federal Genocide Statute also allows individuals present in the United States to be prosecuted for acts of genocide committed abroad.

Yet, while the Trump administration aggressively detains immigrants and protesters, an Israeli military commander implicated in serious war crimes is walking freely through the streets of New York City, enjoying his life. What does it say about American justice when those responsible for the killing of Palestinian children are welcomed into our country without consequence? The entire post-civil rights era is predicated on the notion that no one is less-than because of her nationality or race, yet this Administration – and the one that came before it – have sent a clear message to Americans of Palestinian origin and Arabs throughout the world: your lives are worthless. This cannot be the basis for a just foreign policy.

This selective enforcement and blatant racism is an insult to our laws, a betrayal of the victims, and another devastating blow to America’s international credibility. No country should be above the law. And America must never become a safe haven for those responsible of genocide — especially in the name of Israel.”
